Today the Dan Frei for Congress campaign filed a complaint with the Office of Congressional Ethics against Representative Don Bacon requesting an inquiry into the mass communication being aired on KFAB radio and being paid for with taxpayer funds under a “house.gov” account.
Pages 139 and 140 of the House Ethics Manual (December 2022 version), outline the prohibition of unsolicited mass communications within 90 days of an election. The advertisement in question is a testimonial from Representative Don Bacon himself describing how his office helped a constituent with an IRS issue.
The complaint in part reads, “This 'advertisement' seems to demonstrate disregard for the ‘90-day’ rule and most certainly a complete disregard for the ‘spirit’ of the rule and the ethical principle behind the rule.”
Dan Frei stated “I’m disappointed that lodging such a complaint was necessary. Americans are known for their sense of fair play and know something is unfair when they see it. Using taxpayer funds in this way when Don Bacon has such a monetary advantage in campaign funds is perplexing to say the least.”
